Pursuant to Title 17, United States Code, Section 512(c) of the Digital Millennium Copyright Act, a copyright owner or their agent may submit a takedown notice to us through our DMCA agent listed below. As an Internet Service Provider, we have the right to seek immunity from such infringement claims under the “safe harbor” provisions of the DMCA. To file a bona fide infringement claim with us, you must submit a notice to us that includes the following information:

Notice of Infringement – Claims

  1. A physical or electronic signature of the copyright owner (or a person authorized to act on behalf of the owner).
  2. Identification of the copyrighted work claimed to have been infringed.
  3. Identification of the infringing material to be removed, and information reasonably sufficient to permit Service Provider to locate the material. (Please submit the URL of the page in question to help us identify the allegedly violating work).
  4. Information sufficient to allow the service provider to contact the complaining party, including your name, physical address, email address, telephone number, and fax number.
  5. A statement that the complaining party believes in good faith that use of the material is not authorized by the copyright agent.
  6. A statement under penalty of perjury that the information in the notification is accurate and that the complaining party is authorized to act on behalf of the copyright owner.

Title 17 USC 512(f) provides civil damages, including costs and attorneys’ fees, for any person who willfully and materially misrepresents certain information in a notice of infringement pursuant to 17 USC 512(c)(3) .

Counter Notification – Restoration of Material

If you receive notice of material being removed due to a claim of copyright infringement, you may provide us with a counter-notification in an effort to restore the material in question to the Site. Such notice must be in writing to our DMCA Agent and must contain essentially the following elements pursuant to 17 USC Section 512(g)(3):

  1. Your handwritten or electronic signature.
  2. A description of the material that was removed, and the location of the material before it was removed.
  3. A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of a mistake or misidentification of the material to be removed or disabled.
  4. Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the federal district court in the judicial district in which that address is located (or, if you are outside the United States, in any jurisdiction in which the service provider may be found ), and you will be subject to process services from the person or company that provided the original notice of infringement.
  5. Send your counter notification via our “Contact Us” page. Email is highly recommended.

Repeat Infringement Policy

We take copyright infringement very seriously. As required by the Repeat Infringement Policy of the Digital Millennium Copyright Act, we maintain a list of DMCA notices from copyright owners and make a good-faith effort to identify any repeat infringers. Those who violate our internal Repeat Infringer Policy will have their accounts terminated.
